President Ramaphosa Signs Public Procurement Bill into Law

In a significant development for governance and economic policy, President Cyril Ramaphosa approved the Public Procurement Bill on 23 July 2024, marking a pivotal step towards streamlining and regulating public procurement practices across South Africa. The enacted legislation establishes a unified framework designed to oversee the procurement activities of all state organs. This framework emphasises efficiency, cost-effectiveness, and integrity in the procurement process.

The Public Procurement Act aligns closely with Section 217 of the Constitution to align with constitutional principles, mandating fairness, transparency, and cost-effectiveness in state contracting. The Act addresses past procurement weaknesses linked to corruption and state capture, aiming to enhance transparency and accountability.

One of the Act’s key objectives is to consolidate and streamline the various fragmented regulations that currently govern procurement by state organs. And therefore, aims to facilitate the equitable participation of historically disadvantaged individuals and entities in procurement opportunities.

Administered by the Minister of Finance, the Act applies to departments, constitutional institutions, municipalities, and public entities, with certain provisions extending to Parliament and provincial legislatures. It prohibits bids from certain public officials to ensure integrity and fairness in the procurement process. The Act also introduces measures to promote economic development through preferential procurement practices that prioritise goods produced, and services provided within South Africa. This developmental approach is expected to stimulate local industries and enhance economic growth.

The Act seeks to optimise the use of public resources and promote broad-based economic transformation. It emphasises the use of technology to enhance efficiency and effectiveness in procurement processes. By regulating who may submit bids, including restrictions on public office bearers and certain employees, the Act aims to further safeguard transparency and integrity in the procurement process.
